OBLIGATIONS AND LIABILITIES OF THE WEBSITE USER
The User undertakes to:
a) Use the Website and its contents and services in an appropriate and legal manner, in accordance with: (I) applicable legislation at any given time; (II) General Conditions for Use of the Website; (III) generally accepted customs and good practice and (IV) public order.
b) To have the technical means and requirements available for use as necessary to access the Website.
c) To provide accurate information when filling in personal details on forms contained within the Website and to keep these updated at all times in such a manner as to ensure these are the correct current User details. The User is held solely responsible with regard to any false or inaccurate statements given by the user and any harm caused to TOUS or to any third parties as a result of the information provided.

(V) Either induces or may induce an unacceptable state of anxiety or fear.
(VI) Either induces or may induce a person to become involved in practices that are dangerous or that involve risk or may be harmful to health or mental well being.
(VII) Is protected under legislation governing intellectual or industrial property rights pertaining to TOUS or to any third parties unless the particular intended use has been expressly authorised.
(VIII) May be contrary to honour, personal or family privacy or to one’s personal image.
(IX) Constitutes any form of advertising.
(X) Includes any form of virus or programme which may prevent the Website from working properly.
If provided with a password in order to access any of the Website services and/or content, the User undertakes to make use thereof in a diligent manner and to keep it secret at all times. The User is therefore deemed liable for its safekeeping and confidentiality and undertakes not to permanently or temporarily assign the password to any third parties, nor to allow any outside person to access the aforementioned services and/or content. The User equally undertakes to inform TOUS of any fact which may lead to improper use of that password such as, for example, theft or loss of the password or any unauthorised access, so that it may be immediately cancelled. Therefore, for as long as such circumstances are not notified, TOUS is deemed exempt of any liability which may arise from any undue use of the User password and the User is deemed liable for any illegal use of the Website contents and/or services by any illegitimate third party.
In the event that the User either negligently or intentionally breaches any of the obligations established under these General Conditions for Use, he or she will be deemed liable for any damages which may be incurred by TOUS as a result of that breach.
LIABILITIES
TOUS does not guarantee continuous access to the Website, nor correct visualisation, downloading or use of any elements or information contained on the TOUS pages which may be hindered, rendered difficult or interrupted by factors or circumstances beyond its control.
TOUS does not accept liability for any decisions which may be taken as a result of accessing the content or information provided.
TOUS may either interrupt the service or immediately terminate the relationship with the User if the former detects that any use of its Website or of any of the services offered on it are contrary to these General Conditions for Use. TOUS may not be deemed liable for any damages, harm, loss, claims or costs arising out of the use of its Website. It is only responsible for deleting content which may give rise to such harm, as quickly as possible, as long as it is notified in that regard. It may particularly not be deemed liable for any harm which may arise, among others, from:

(IV) safety feature or browsing errors produced by a browser malfunction or by the use of versions of the browser that have not been duly updated. TOUS administrators reserve the right to either totally or partially withdraw any content or information present on the Website. TOUS does not accept liability for any damages of any kind which may be due to the improper use of freely available services or use of the Website by Users. Equally, TOUS is deemed not to be liable for any content or information which may be received as a result of forms containing data as these are deemed to be solely for the purpose of providing advice and response to queries. Furthermore, if any damages are caused as a result of illegitimate or incorrect use of such services, TOUS may claim against the User for any damages caused. You are to defend, compensate and support TOUS with regard to any damages or harm which may arise out of any claims, actions or allegations brought by third parties as result of your accessing or using the Website.
